Régimen jurídico de la utilización por una Parroquia de la Iglesia de un antiguo Convento desamortizado. (RI §406970)

El objeto de este trabajo es realizar un estudio jurídico de la situación legal de un convento afectado por la legislación desamortizadora del siglo XIX. Como consecuencia de tal legislación, el convento se convirtió en Casa de Beneficencia gestionada por la Diputación. Más adelante, ya en la segunda mitad del siglo XX, la Diputación cedió a la Iglesia el uso del templo del antiguo convento (como parte separada de la Casa de Beneficencia), el cual pasó a constituir la iglesia de una Parroquia Con este estudio se pretende también determinar qué títulos jurídicos tiene la Parroquia (y en definitiva la Iglesia Católica) sobre el templo cuyo uso (que no titularidad) le fue cedido, así como sobre algunos bienes muebles dedicados al culto y anteriores a la desamortización depositado en el templo. El estudio de este caso concreto nos permitirá conocer la situación jurídica de antiguos monasterios o conventos que finalmente fueron cedidos a la Administración Local (normalmente a los Ayuntamientos) para ser destinados a fines de interés público.

La desamortización del convento en aplicación de la legislación de 1835-1842. 2 Los posibles efectos derivados de las leyes de devolución al clero de los bienes desamortizados y no enajenados. 3 Conclusión: la titularidad del convento de los dominicos de Castellón tras la aplicación de la normativa comentada. III. LA CESIÓN DEL USO DE LA IGLESIA A FAVOR DE LA PARROQUIA. IV. LA TITULARIDAD DE LOS BIENES MUEBLES EXISTENTES EN LA IGLESIA. V. SOBRE UNA FUTURA CESIÓN VOLUNTARIA POR PARTE DE LA DIPUTACIÓN PROVINCIAL DE LA PROPIEDAD DE LA IGLESIA A FAVOR DE LA PARROQUIA. VI. CONCLUSIONES.

The object of this paper is to analyze the legal situation of a convent affected by the disentailing legislation of the 19th century in Spain. As a consequence of such legislation, the convent turned into a Children's home managed by the County Council (Diputación). Later on, in the second half of the 20th century, the County Council handed over to the Church the use of the temple of the former convent (as a part separated from the Children's home), which became the church of a Parish. This study tries to determine also what legal titles has the Parish (and ultimately the Catholic Church) on the temple whose use only (and not its property) was hander over, as well as on some personal property dedicated to the worship and previously to the disentailment and deposited in the temple. The study of this concrete case will let us know know the legal situation of former monasteries or convents that finally were handed over to the Local Administration (usually the town halls) to be addressed to purposes of public interest.
