Some reflections about the possible influence of american constitutionalism on spain, on the subject of freedom of expression - Joaquín Borrell Mestre

La Constitución estadounidense ha tenido gran influencia en la elaboración de otras constituciones. Sin embargo, y por lo que respecta a España, esta repercusión sólo ha sido importante en el texto de la Constitución de 1869 y en el proyecto republicano de 1873, tanto en general como concretamente en cuanto a la libertad de expresión. Éste no ha sido el caso de la actual Constitución española, de 1978. Ahora bien, el Tribunal Constitucional español, a la hora de interpretar esta Constitución, ha utilizado algunas construcciones elaboradas por el Tribunal Supremo norteamericano. En el ámbito de la libertad de expresión, esta recepción se ha producido tanto de manera directa, como puede verse en el caso de la difamación, como de manera indirecta, a través de la jurisprudencia del Tribunal Europeo de Derechos Humanos, como ha ocurrido en el caso de la publicidad comercial.

The American Constitution has had a lot of influence on the drafting of other constitutions. Nevertheless, with regard to Spain, this repercussion has only been important on the text of the Constitution of 1869 and in the republican project of 1873, as well generally as in the context of freedom of expression. This is not the case of the present Spanish Constitution, drafted in 1978. Notwithstanding, the Spanish Constitutional Court, when interpreting this Constitution, has used some constructions which had been formulated by the Supreme Court of the United States. Within the scope of freedom of expression, this reception has taken place directly, as we can see in the case of defamation, as well as in an indirect way, through the doctrine of the European Court of Human Rights, as it happened in the case of commercial advertising.
