Este artículo presenta un análisis lingüístico y comparativo de los textos de la Constitución italiana de 1948 y de la Constitución francesa de 1958. La colocación del género textual de la constitución entre las tipologías elaboradas a propósito de las producciones escritas jurídicas, nos lleva, por un lado, a explorar las peculiaridades lingüísticas y pragmáticas del nivel macrotextual destinadas a conferir al texto su poder normativo. Por otro lado, nos lleva a examinar los dos textos de manera puntual con el objeto de identificar los aspectos convergentes y divergentes de ambos a nivel microtextual, en particular, con respecto a la expresión del principio de igualdad en los dos Países.

This paper presents a comparative linguistic analysis of the texts of the Italian Constitution of 1948 and the French Constitution of 1958. The collocation of a Constitution as text genre within typologies that have been elaborated for legislative discourse leads us, on one hand, to investigate at the macro-textual level the linguistic and pragmatic characteristics which function to grant these texts their normative power; on the other hand, we focus on the micro-level in detail, for the purpose of revealing convergences and divergences between the linguistic construction of the notion of equality in these two nations.

Cette contribution présente une analyse linguistique et comparée des textes de la Constitution italienne de 1948 et de la Constitution française de 1958. La collocation du genre textuel de la constitution parmi les typologies de productions juridiques nous conduit à nous interroger sur les spécificités linguistiques et pragmatiques du niveau macrotextuel qui lui confèrent son pouvoir normatif. Nous passerons ensuite à un examen plus ponctuel, apte à relever les convergences et les divergences éventuelles du niveau microtextuel, notamment en ce qui concerne l’expression du principe d’égalité dans les deux Pays.
