El derecho a la libre circulación de trabajadores ha sido recientemente revisado con la publicación de la Directiva 2004/38/CE que reúne en un único texto el corpus legislativo vigente en la Unión Europea en materia de derechos de entrada y residencia de los ciudadanos de la Unión, regulando las condiciones de ejercicio del derecho a la libre circulación de los trabajadores de la U.E. y de sus familias, el derecho de residencia permanente y restringiendo dichos derechos por razones de orden público, seguridad y salud pública. Además se analizan en este trabajo los derechos instrumentales al de libre circulación que hacen efectivo el correcto desarrollo de éste.

I. El ámbito subjetivo de aplicación de la libre circulación de trabajadores. 1.1. El concepto de trabajador. 1.2. El significado a efectos del ejercicio del derecho a la libre circulación. 1.3. The right to the workers' free traffic has been recently checked by the publication of the Directive 2004/38/CE that assembles in the only text the legislative in force corpus in the European Union as for rights of entry and residence of the citizens of the Union, regulating the conditions of exercise of the right to the free traffic of the workers of the U.E. and of your families, the right of permanent residence and restricting above mentioned rights for reasons of public order, safety and public health. In addition the instrumental rights are analyzed in this work to that of free traffic that they make the correct development effective of this one.
