El Tribunal Supremo ha establecido recientemente en qué supuestos la cesión de trabajadores a través de empresas de trabajo temporal puede constituir una cesión ilegal sujeta al régimen del art. 43 de la Ley del Estatuto de los Trabajadores. Al mismo tiempo, ha resuelto que, en el seno de la misma Ley, su art. 16.3 no puede considerarse una excepción a su art. 43.

The Supreme Court has established recently in which supposed the cession of workers through Temporary Employment Agencies he can constitute a subject illegal cession to the regime of the art. 43 of the Workers’ Statute. At the same time, he has solved that, in the same Law, his the art. 16.3 cannot consider an excepcion to this art. 43.
