La patria potestas otorgaba al paterfamilias unos omnímodos poderes sobre sus subiecti pudiendo incluso decidir sobre la vida o la muerte de sus filii. La relación paterno-filial podía constituirse ex iure al margen de la procreación. Estos poderes se fueron dulcificando como consecuencia del paso de la familia agnaticia a la cognaticia, la mayor capacidad patrimonial de los filii vía peculios y el proceso de emancipación femenina, en virtud del cual el matrimonium dejó de estar acompañado de la conventio in manum que integraba a la esposa en el grupo agnaticio-familiar del marido. La estrecha relación entre ambos institutos hasta mediados de la República generó en la doctrina la errónea opinión de la existencia de dos tipos de matrimonio en Roma, uno cum manu y otro sine manu, reservando el calificativo de materfamilias a la esposa in manum mariti.

The patria potestas granted to the paterfamilias some absolute powers over their subiecti. He can also decede about the life or death over their filii. The paternal-filial relationship could be set up ex iure, regarless of the procreation. These powers were attenuated as result of the agnate to the cognate family traslation, the bigger heritage capacity of the filii through peculia and the female emancipation process which permissed the separation between matrimonium and conventio in manum. The wife entering manus was integred into husband’s agnatice family. The primitive close relationshipbetween both instituts as far as the middle of Republic generated in the doctrine the wrong knowledge of the existence of two tipes of marriage at Rome, one cum manu and other one sine manu, kepting the title of materfamilias to the wife in manum mariti.
