Insecure security. Legal concept of human security against the warlike discourse -

Este artículo fue originalmente una conferencia dictada en el 9.º Seminario del Instituto Brasilero de Ciencias Criminales en San Pablo, Brasil. Para su publicación en www.iustel.com he intentado limitar las referencias cruzadas, pero mantiene en gran medida el estilo oral en que fue expuesta. Describe, en primer lugar, los problemas actuales de la “globalización”, que son los verdaderos creadores de una mayor -y nueva- inseguridad. Luego menciona la falsa respuesta frente a la inseguridad que efectúan unos Estados con poco poder social y económico. Remarca que el poder que retienen y aumentan los Estados es el penal y policial. Por ello el artículo critica las políticas criminales “del riesgo” y las “del enemigo”, pues ambas reproducen un discurso bélico -y de una efectiva guerra- al interior de los Estados. Ello aumenta la inseguridad, en una especie círculo vicioso. Finalmente, el artículo intenta recuperar el discurso jurídico crítico para, sin abandonar el problema de la seguridad, articular un límite a dichas políticas estatales y poner un punto de partida para encontrar nuevas y verdaderas soluciones a los problemas sociales.
This article has originally been a conference pronounced in the course of the 9th Seminary of the Instituto Brasilero de Ciencias Criminales in San Pablo, Brazil. In order to publish it in www.iustel.com I have tried to limit crossed references, but it keeps to a great extent the spoken word in which it was expound. First of all, it describes the “globalisation” present problems, real responsible of a mayor –and a new- insecurity. Then, it mentions the false respond to insecurity given by some States with not much social and economic power. It emphasizes that is the criminal and police power the one keep and increase by States. That’s the reason the article criticizes the criminal policy calls “of risk” and “of the enemy”, given that they reproduce a warlike discourse –and a real war- inside the States. That increases the insecurity, in a sort of vicious circle. Finally, the articles tries to recover the critical legal speech, keeping the security problem, in order to articulate a limit for those government policy, and to find new and real solutions to the social problems.
