Legal sources at Treaty establishing a Constitution for Europe: a prospective analysis - José M.ª Baño León

Analiza el autor en el presente trabajo el sistema de fuentes comunitarias establecido en el Tratado por el que se establece una Constitución para Europa. Este sistema se caracteriza por las siguientes notas: simplificación de normas, mayor separación entre el legislativo y ejecutivo, reconocimiento a la Comisión de una potestad reglamentaria condicionada a la autorización del poder legislativo, mantenimiento de un poder reglamentario sujeto a restricciones atribuible a la Comisión y al Consejo, existencia de una potestad reglamentaria independiente y establecimiento de una relación de jerarquía entre la Ley comunitaria y el Reglamento comunitario, aún cuando el Reglamento pueda estar habilitado para modificar preceptos no esenciales de la Ley comunitaria.

LA POTESTAD REGLAMENTARIA DE LA COMISIÓN COMO POTESTAD DELEGADA.- VI. LOS REGLAMENTOS INDEPENDIENTES O DIRECTAMENTE VINCULADOS A LA CONSTITUCIÓN.- VII. LAS FUENTES EN LA CONSTITUCIÓN EUROPEA COMO POSIBLE MECANISMO DE EXPANSIÓN DE LOS PODERES DE LA UNIÓN FRENTE A LOS ESTADOS MIEMBROS.

The author analyses the European community legal sources provide in the Treaty establishing a Constitution for Europe. These are the characteristics of this system: simplification on the regulatory scheme, more separation of the legislative and the ejecutive power, the rule-making power of the European Commission is limited by the legislative power authorization, European Commission and Council of European Union restrictive power of making regulations, independent rule-making power and hierarchy relation between European Community Law and European Community rules, even though the regulation is qualified to modify European Community Law non essential principles.
