Towards the corporate social responsibility. Some critical remarks in the labour relations perspective

La creciente importancia que ha alcanzado la responsabilidad social corporativa reclama progresivamente la atención de los especialistas, vacilantes ante la estrategia elaborada para otorgar una mejor imagen a la empresa capitalista. Sin embargo este comentario quiere llamar a las cosas por su nombre porque la empresa es, ante todo, “persona interesada” en el empeño. La Sala Cuarta (Social) del Tribunal Supremo ha situado esta cuestión bajo la esfera jurídica del poder de dirección, pero esta tesis no puede compartirse porque la responsabilidad social corporativa es voluntaria (área autonómica) por hipótesis, en tanto que la orden dictada por el empleador es coactiva (área heterónoma) por hipótesis.

Growing importance that Corporate Social Responsibility to attract more and more attention of the specialists, hesitate about the strategy that is going to allow a more image of the company. However, this comment will to call a spade a spade, because the company is, on the other hand, self-interested person. The Fourth (Social) Chamber of the Supreme Court has considered this issue under the theory of the application of the executive powers and organization. But these theory ignore that the corporate social responsibility appertain, by definition, to voluntary area (autonomous area), whereas the order of the employer is necessarily coercive (heteronomous area).
