El artículo versa sobre la teoría de la culpabilidad y los fines de la pena, con especial referencia al pensamiento de Claus Roxin. The article deals with the theory of the guilt and the purposes of the punishment, with special reference to Claus Roxin's thought. Concept, structure with relation to the unjust one, and function of the guilt they treat each other as interconnected problems, with relevancy to the foundation of the Criminal law, the theory of the crime, and the individual punishment (sentencing).
