An essay about the juridical configuration of the term domicilium in the Roman Law - M.ª Luisa López Huguet

El primer vínculo del hombre con el territorio vino representado por la sedes, identificada con la habitación en la domus familiar que fue sustituida a partir del siglo II a. C. por el domicilium, término que deriva etimológicamente de aquélla y con el que se indicaba el lugar donde una persona había establecido su residencia permanente con independencia de toda modalidad de propiedad o habitación y que constituía, con carácter general, el centro de sus actividades vitales. La estabilidad inherente al domicilio venía concretada por el establecimiento efectivo y por la voluntad actual de permanencia, lo cual la hacía compatible con ausencias temporales y no excluía un ulterior traslado domiciliario. Para el mismo, igual que para su constitución, era necesario el establecimiento real en el lugar elegido lo que comportaba que, con carácter general, el domicilio fuese único. Sin embargo, de forma excepcional, se admitió que una persona pudiera tener una pluralidad de domicilios y que pudiera carecer del mismo.

Las referencias al domicilium en las fuentes jurídicas: reinterpretación de algunos pasajes relativos a la sinonimia domus-domicilium.- III. HIPÓTESIS SOBRE LA DATACIÓN DE LA ELABORACIÓN TÉCNICO-JURÍDICA DE LA NOCIÓN DOMICILIUM: 1. Continuación: Constitución, abandono y traslado de domicilio. Supuestos de pluralidad de domicilios y de ausencia del mismo.- IV. POSIBLES OSCILACIONES A LA CONFIGURACIÓN DEL DOMICILIO COMO RESIDENCIA ESTABLE DEL INDIVIDUO: 1. El domicilio en el ámbito de las relaciones ciudad-campo. 2. El domicilio de las actualmente denominadas personas jurídicas.

The first link of the human being with the land was represented by the sedes identified with the habitatio in the familiar domus. From the 2nd and 1st century BC, the familiar domus was substituted by the domicilium, term which derives etymologically from that. Besides, the term domicilium pointed out the place where someone set up their residence regardless of whether it was a property or a room, and it constituted, in general terms, the centre of their vital activities. The stability inherent to the domicile was defined by the effective establishment and the actual will of permanence, which was compatible with temporal absences and it didn’t excluded a further relocation of their domicile. For the relocation and its constitution, it was necessary the real establishment in the chosen place, what makes that the domicile was unique. Although, it was exceptionally allowed that someone could have several domiciles and that they could lack it.

HYPOTHESIS ABOUT THE DATE OF THE TECHNICAL-JURIDICAL ELABORATION OF THE NOTION DOMICILIUM: 1. Continuation: Constitution, withdrawal and recolation of the domicilium. Plural domicile and domicile’s absence.- IV. POSSIBLE FLUCTUATIONS TO THE CONFIGURATION OF THE DOMICILE AS PERMANENT RESIDENCE OF THE INDIVIDUAL: 1. The domicile in the area of the city-country relationship. 2. The domicile of the so called juristic persons.
