En el marco del Derecho comparado hoy se observan dos líneas de actuación contradictorias en torno a la familia: una, de tempus rapido, que prosigue la erosión de las características fundamentales del matrimonio occidental; otra, de tempus más lento, en la que se observa un "retorno" del matrimonio tradicional. Se analiza en este trabajo esta segunda línea en dos notas esenciales del matrimonio: la estabilidad y la heterosexualidad. Especial interés tiene el análisis del fenómeno de "blindaje" que se observa en el derecho anglosajón y en latinoamérica en relación con los matrimonios homosexuales aprobados en una pequeña minoría de Estados.

Within the framework of the comparative law today two contradictory lines of performance around the family are observed: one, of tempus fast one, that continues the erosion of the fundamental characteristics of the western marriage; other, of tempus slower, in which a “return” of the traditional marriage is observed. It is analyzed in this work this second line in two essential notes of the marriage: the stability and the heterosexuality. Special interest has the analysis of the phenomenon of “shield” that is observed in the Anglo-Saxon right and in Latin America in relation to the approved homosexual marriages in a small minority of States.
