Nuevas tendencias en la protección por desempleo. El supuesto de la reducción parcial de la jornada. Comentario al Real Decreto 200/2006, de 17 de febrero. (RI §400154)  


Unemployment protection trends: the case of part- time work reduction. Commentary of Real Decreto 200/2006, 17th february - Eva María Blázquez Agudo

La protección por desempleo precisa ser modificada con el fin de adaptarla a la realidad social. Recientemente el RD 200/2006, de 12 de febrero ha incluido ciertos cambios en esta prestación, pero no ha logrado establecer una reglamentación totalmente actualizada y completa. En este sentido, aún quedan ciertas cuestiones que necesitan ser renovadas, tal y como ha sido puesto de manifiesto en ocasiones por la jurisprudencia del Tribunal Constitucional. Dentro de este ámbito, se analiza el supuesto de la reducción parcial de la jornada y su repercusión en el acceso al desempleo. En concreto, se ha examinado si la anterior regulación, que denegaba el beneficio cuando la aminoración de la jornada laboral era definitiva, conculcaba el artículo 14, 35 y 41 de la Constitución.

The unemployment protection should be modificated in accordance with social needs. The RD 200/2006 has included several changes in this benefit, nevertheless, it is not a complete and present-day law. In this sense, there are a lot of questions which ought to renew. In particulary, the Constitutional Court has analysed the case of part- time work reduction and its relation with unemployment protection. The previous regulation refused the benefit when the aminoration of time work was definitive. According to this, it has been examined the violation of same constitutional articles (14, 35 and 41).
