Inexequibilidad del piso de protección social y acuerdo derogatorio del Decreto 1174/2020 de Colombia: alcances y consecuencias. (RI §428586)

El presente trabajo es producto de un proyecto de investigación(1), que estudia los aconteceres del derecho laboral y la seguridad social en Colombia; en esta oportunidad nos enfocamos en las medidas introducidas en el plan nacional de desarrollo a fin de implementar el piso de protección social en nuestro ordenamiento jurídico. Para el desarrollo de este artículo, se acudió al método descriptivo y documental, contando con un enfoque cualitativo que permite identificar normas y jurisprudencia del orden constitucional. El trabajo procura dar elementos al lector respecto al piso de protección social desde el componente internacional; la línea de acción seguida por el ejecutivo para implementarlo en Colombia; así como las visiones defendidas por la Corte Constitucional, quien critica la postura del ejecutivo, puesto que es una disposición del sistema de seguridad social de índole transversal, que debería ser regulada mediante un procedimiento legislativo ordinario previsto en la Constitución. El articulo finaliza con el acuerdo derogatorio celebrado entre el gobierno y las centrales obreras, respecto a uno de los decretos que lo regulaba, soportado en el derecho a una pensión digna.

This article is the result of a research project that studies developments in labor law and social security in Colombia. This time, we focus on the measures introduced in the National Development Plan to implement the social protection floor in our legal system. For the development of this article, we used a descriptive and documentary method, relying on a qualitative approach that allows us to identify constitutional norms and jurisprudence. This article seeks to provide the reader with information regarding the social protection floor from an international perspective; the line of action followed by the executive branch to implement it in Colombia; and the views defended by the Constitutional Court, which criticizes the executive branch's position, since it is a cross-cutting provision of the social security system that should be regulated through an ordinary legislative procedure provided for in the Constitution. The article concludes with the repeal agreement reached between the government and the labor unions regarding one of the decrees that regulated it, based on the right to a decent pension.
