El estudio analiza la reciente regulación peruana sobre la participación del sindicato en conflictos individuales. A partir de la Teoría General del Proceso y efectuando una interpretación “desde y conforme” a la Constitución el autor concluye que dicha participación constituye una forma de representación procesal voluntaria que permite armonizar los principios, valores y derechos que la Constitución Peruana consagra.

The study analyzes the recent Peruvian regulation about the trade union’s participation in the individual conflicts. From the General Theory of the Process and making an interpretation from and according the Constitution, the author concludes that such participation is a form of voluntary procedural representation for harmonizing the principles, values and rights enshrined in the Peruvian Constitution.
