Artificial intelligence in the comprehensive law for equal treatment and non-discrimination - Aránzazu Vicente Palacio

La LIIND dedica un precepto específico a la inteligencia artificial (art. 23) así como sendos preceptos al derecho a la igualdad y no discriminación en el trabajo por cuenta ajena (art. 9) y al papel de la negociación colectiva en esta última materia (art. 10). Este trabajo analiza la virtualidad de estas normas para prevenir y reparar la discriminación algorítmica en el ámbito laboral.

I. UNA PRIMERA IMPRESIÓN ACERTADA: EL NULO CONTENIDO NORMATIVO DEL ART. 23 LIIND.- II. EL CONTEXTO REGULADOR: LA ESTRATEGIA NACIONAL DE INTELIGENCIA ARTIFICIAL, LA CARTA DE DERECHOS DIGITALES Y “LAS INICIATIVAS EUROPEAS EN TORNO A LA INTELIGENCIA ARTIFICIAL”.- III. ¿DE QUÉ HABLAMOS CUANDO HABLAMOS DE INTELIGENCIA ARTIFICIAL?.- IV. The LIIND dedicates a specific precept to artificial intelligence (art. 23) as well as separate precepts to the right to equality and non-discrimination in employment (art. 9) and the role of collective bargaining in this last matter (art. 10). This paper analyzes the potentiality of these rules to prevent and repair algorithmic discrimination in the workplace.
