Conscientious objection in Portugal. Ethical conflicts, classical problems and contemporary challenges - Jónatas E. M. Machado

En este artículo solo hemos tenido la oportunidad de tocar brevemente y de manera simplificada algunos de los muchos problemas de conciencia que enfrentamos hoy en las sociedades plurales modernas. Para algunos, el ideal liberal de responsabilizar a cada individuo de la construcción de su propio proyecto de vida, a pesar de su innegable potencial positivo, corre el riesgo de caer en una cacofornia ética y normativa y en un subjetivismo extremo. No existe un consenso moral sobre la identificación de los derechos humanos y la determinación de su contenido. Incluso las cuestiones de saber qué cuenta como humano y cuáles son las consecuencias normativas resultantes ya no son consensuales. Vivimos en sociedades estructuradas en torno al "politeísmo normativo". Diferentes ideologías buscan apoderarse del proceso de determinación cuantitativa y cualitativa de estos derechos y ponerlos al servicio de su agenda. Las posibilidades de conflictos de conciencia tienden a aumentar exponencialmente, al igual que el riesgo de fractura del tejido social. La simple apelación a los derechos humanos no contribuye a resolver cuestiones legales y éticas, solo inicia intensos debates ideológicos, filosóficos, políticos, legales y hermenéuticos. La solución a estos conflictos puede variar según el contexto histórico, normativo, social y cultural y las posibilidades prácticas de acomodar las distintas pretensiones de conciencia, buscando siempre armonizar y maximizar los derechos e intereses en colisión y contribuir al aumento de la cohesión social.

In this article, we only had the opportunity to touch briefly and simply on some of the many problems of conscience that we face today in traditional plural societies. For some, the liberal ideal of holding each individual accountable for the construction of their own life project, despite its undeniable positive potential, runs the risk of falling into an ethical and normative cacophornia and extreme subjectivism. There is no moral consensus on the identification of human rights and the determination of its content. Even the questions about what counts as human and what are the resulting normative consequences are no longer consensual. We live in societies structured around "normative polytheism". Different ideologies seek to take advantage of the process of quantitative and qualitative determination of these rights and put them at the service of their agenda. The chances of conflicts of consciousness tend to increase exponentially. The solution to these conflicts can vary according to the historical, norm, social and cultural context and the practical possibilities of accommodating the different pretensions of conscience, always seeking to harmonize and maximize the rights and interests in collision and contribute to the increase of social cohesion.
