El presente artículo analiza la creación y desarrollo del Consejo de Kortenberg debido a la aparición de la Carta de Kortenberg de 1312, período de especial conflicto político. Los acontecimientos que condujeron a la adopción de dicha Carta representaron un pacto solemne y transversal del que tomaron parte los principales agentes del Ducado de Brabante, jugando un papel destacado el tercer orden. Como se podrá apreciar en el artículo que sigue, la contribución y reflexión más seria en torno a esta cuestión ha sido proporcionada por Joseph van der Straeten (1918-2010), cuyo trabajo sobre esta institución política, separada del poder real y de naturaleza judicial, muestra que no se trató de un fenómeno aislado en Europa a pesar de contar con algunas características únicas.

This article analyzes the emergence of the Council of Kortenberg by means of the enactment of the Charter of Kortenberg of 1312, a moment of special political conflict. The events that led to the adoption of the Charter represented a solemn and transversal pact in which the most important agents of the Duchy of Brabant took part of it, playing a special role the Third Order. As will be seen in this article, the most serious contribution and reflection on this matter was provided by Joseph van der Straeten (1918-2010), whose work on this political institution, separated from the royal power and that had a judicial nature, shows that it was not an isolated phenomenon in Europe despite having some unique characteristics.
