Propuesta de futuro para la justicia de paz en España. (RI §419722)  


A future proposal for justice of piece in spanish legal system - Ixusko Ordeñana Gezuraga

La justicia de paz es tema controvertido, desde antiguo, en nuestro ordenamiento jurídico. Entendiendo que la decisión, por parte del legislador, sobre su futuro (desaparición o reforzamiento) no puede dilatarse más en el tiempo, el autor realiza un análisis de su pasado histórico y su régimen jurídico vigente, para, tras mostrar sus debilidades y fortalezas, presentar una solución para su futuro. Concretamente, el autor propugna lege ferenda su conversión en centros municipales de resolución de conflictos en el marco del derecho jurisdiccional diversificado.

Justice of peace is a controversial subject, since ancient times, in our legal system. Understanding that the decision of the legislator on its future (disappearance or reinforcement) cannot be extended more in time, the author makes an analysis of its historical past and its current legal regime in order to, after showing its weaknesses and strengths, present a solution for its future. Specifically, the author proposes lege ferenda its conversion into municipal centers of conflict resolution in the framework of the diversified jurisdictional law.
