El presente trabajo pretende analizar las posibilidades de defensa de los particulares frente a restricciones a la libertad de empresa, sobre todo de índole regulatoria. Esta cuestión ha cobrado gran actualidad a raíz de la atribución a la Comisión Nacional de los Mercados y la Competencia de legitimación activa para impugnar las normas de rango inferior a la ley ante los órganos de la jurisdicción contencioso administrativa. Se analiza también la relación que existe entre la libertad de empresa y la libertad de circulación, sobre todo teniendo en cuenta la relación de estos principios con las potestades normativas de las Comunidades Autónomas en el marco competencial definido en la Constitución y el reciente pronunciamiento del Tribunal Constitucional sobre esta cuestión.
The aim of this article is to analyse the opportunities for individuals or companies to defend themselves against restrictions of the right to conduct business, specially of a regulatory nature. This issue has became highly topical as result of the new powers conferred to the CNMC to appeal administrative regulations before the contentious administrative jurisdiction bodies. It also analyses the relationship between the freedom to conduct business and the free circulation of goods and services, specially taking into account the relationship between these principles and the regulatory powers of the Autonomous Communities and the recent judgement of the Spanish Constitutional Court regarding this cuestion.
