The model of health law and the difficulty of applying the principles and basic features of the national health system during a crisis - Anunciación Contreras Torres

El derecho a la salud se presenta, protege y garantiza a través de dos modelos básicos admitidos internacionalmente como son, el modelo Beveridge, también denominado de Sistema Nacional de Salud (SNS) y el modelo Bismarck o de Seguridad Social. El SNS español sigue un modelo mixto; esto es, el SNS, como se establece en la LGS y de Seguridad Social (que todavía tiene una relación trasversal con el SNS ya sea por la determinación de los sujetos con derecho a la asistencia sanitaria se realizará a través del INSS, por la relación con el accidente de trabajo y la enfermedad profesional que se regula por el sistema de Seguridad Social. Aunque la parte relativa a la prestación sanitaria se realiza a través del SNS, así como, la entrega de la Tarjeta Sanitaria Individual y prestación sanitaria a los Regímenes Especiales de Seguridad Social que se lleva a cabo por la asistencia sanitaria), se relacionan y se contemplan en la Constitución Española de 1978 (CE) de un modo diferenciado. Se puede decir que es la CE la que asienta este modelo mixto de protección del derecho de la salud en España, ya que de la regulación de la CE se desprende que el derecho público a la salud comprende, por un lado, el derecho de los ciudadanos, como una faceta individual; y por otro lado, una faceta colectiva, en cuanto obligación de los poderes públicos para hacer efectivo el derecho a la salud a través del Estado y las Comunidades Autónoma. La creación del SNS se lleva a cabo con el establecimiento de los principios generales y rasgos característicos que se hacen determinantes del SNS español. Estos principios y rasgos se han plasmado legislativamente, sin embargo, en este artículo además de reseñar los mismos, se va a plantear la dificultad que estos principios y rasgos característicos del SNS tienen para su aplicación en tiempos de crisis.

The right to health is presented, protected and guaranteed through two basic internationally accepted models: The Beveridge model, also called the National Health System (SNS), and the Bismarck or Social Security model. The Spanish SNS follows a mixed model; That is, the SNS (as established in the LGS) and Social Security (which still has a cross-sectional relationship with the SNS either by the determination of the subjects entitled to health care will be made through the INSS, by the relation to the occupational accident and occupational disease that are regulated by the Social Security System. Although the part related to the health care is done through the SNS, as well as, the delivery of the Individual Health Card and health care to the Special Social Security arrangements that are carried out by health care for SNS), are related and considered in the Spanish Constitution of 1978 (CE) in a separate way. It can be said that it is the CE that establishes this mixed model of protection of the right to health in Spain, since the regulation of the CE shows that the public right to health comprises. On the one hand, the right of citizens as an individual part of it. And on the other hand, a collective facet, as an obligation of the public powers to enforce the right to health through the State and the Autonomous Communities. The creation that the SNS is carried out with the establishment of the general principles and special features that are elements essential of the Spanish SNS. These principles are features that have been legislated, however, in this article, in addition to reviewing the same, it will raise the difficulty of applying the principles and basic features of the SNS during a crisis.
