The role of the defendant in criminal investigation through sicentific evidence - Ana Sánchez Rubio

El recurso a la ciencia para la resolución de causas judiciales es un fenómeno en expansión en todos los sistemas procesales. La persona objeto de la investigación es un elemento clave para el esclarecimiento de los hechos a través de técnicas científicas. Sin embargo, pese a la importancia del investigado en la indagación científico-criminal, su presencia no encuentra una regulación específica. En las siguientes líneas se plantean algunas reflexiones dirigidas a reforzar las garantías procesales del investigado ante las diligencias de investigación científico-técnicas.

I.-INTRODUCCIÓN. II.-LA INTERVENCIÓN DEL INVESTIGADO EN LA OBTENCIÓN DE FUENTES DE PRUEBA A TRAVÉS DE MÉTODOS CIENTÍFICOS. 1.-La investigación desarrollada contra una persona no identificada. 2.-Excepciones a la presencia del investigado identificado. 3.-La defensa técnica. 4.-La prueba de descargo. III.-EL INVESTIGADO COMO SUJETO PASIVO DE LA INVESTIGACIÓN CIENTÍFICA. IV.-ALGUNAS CONCLUSIONES. V.-BIBLIOGRAFÍA.

The use of science to the resolution of cases is a growing phenomenon in every legal system. The person being investigated is a key element in order to clarify criminal acts through scientific techniques. However, in spite of the defendant relevance in the scientific investigation, there is not a specific regulation on this point. In the following lines, it will be exposed a reflection on the possibility to strengthen the procedural guarantees of the defendant along the technical and scientific investigation.
