¿Expulsión o salida voluntaria? En torno a la controvertida resolución judicial dictada el 23 de abril de 2015 por el Tribunal de Justicia de la Unión Europea. (RI §418015)

El intenso flujo de migración de extranjeros que ha registrado nuestro país en las últimas décadas ha producido cambios que afectan significativamente a diferentes ámbitos del escenario social (vivienda, comportamientos laborales, culturales, religiosos..). Este hecho ha incrementado la actividad jurídica como respuesta a las situaciones de extranjeros carentes del preceptivo permiso de residencia; el extranjero irregular era sancionado, aplicando la legislación y la jurisprudencia del Tribunal Supremo, con una multa acompañada de salida obligatoria si se trataba de mera estancia irregular o con expulsión y prohibición de entrada en territorio español si a la situación de irregularidad se unían otras circunstancias negativas. La sentencia dictada el 23 de abril de 2015 por el Tribunal de Justicia de la Unión Europea plantea severos problemas a la praxis jurídica que se venía aplicando en nuestro país. En el artículo tratamos de esclarecer el panorama actual; analizamos la legislación española y europea para defender la compatibilidad de la Directiva 2008/115/CE con la legislación española. Por tanto, defendemos la aplicación jurisprudencial conforme a la doctrina establecida por el Tribunal Supremo; respaldamos nuestra propuesta con un conjunto de pronunciamientos emitidos en el último año.

The intense migration flow of aliens that our country has witnessed in the last few decades has produced changes that affect significantly different areas in the social scenario (housing, labour, cultural and religious behaviour, etc.). This fact has increased the legal activity as a response to the situations in which aliens without the mandatory residence permit find themselves. Applying the relevant legislation and the case law established by the Supreme Court, undocumented aliens used to be liable to a fine, together with their compulsory expulsion from the country in the case of a mere irregular stay or together with their expulsion and prohibition to enter the Spanish territory in case their irregular stay went hand in hand with other negative circumstances. The judgement issued on 23 April 2015 by the Court of Justice of the European Union created several issues concerning the legal praxis that had been applied in our country henceforth. In this essay we will try to clarify the present situation and will analyse the Spanish and European legislation to defend the compatibility of Directive 2008/115/EC with Spanish law. We will therefore advocate for the case law application according to the criteria established by the Supreme Court and we will support our proposal with a set of resolutions issued during the last year.
