La figura de la gestión de negocios ajenos en el proceso: la inadmisibilidad de una pretendida sustitución procesal extralegal o “sine titulo”. (RI §417335)

El objeto de este trabajo es analizar si cabe –o no–, y por qué, trasladar al proceso civil español la figura de la gestión de negocios ajenos o negotiorum gestio de los artículos 1888 y ss. CC, dando lugar a un supuesto de sustitución procesal extralegal o sine titulo. La conclusión es negativa por varios motivos que muestran la incompatibilidad de la gestión oficiosa con las reglas del proceso civil español y su separación de la figura de la sustitución procesal.

Teorías sobre los efectos de la gestión de negocios ajenos.– 3. LA INADMISIBILIDAD DE LA GESTIÓN REPRESENTATIVA SIN PODER EN EL PROCESO CIVIL ESPAÑOL.– 4. LA FALTA DE PREEXISTENCIA DE LOS ELEMENTOS DE LA GESTIÓN OFICIOSA Y LA CONSECUENTE AUSENCIA DE LEGITIMACIÓN DEL GESTOR.– 5. SEPARACIÓN ENTRE GESTIÓN DE NEGOCIOS AJENOS Y SUSTITUCIÓN PROCESAL.

This paper analyzes if it is possible –or not--, and why, to apply to the Spanish civil procedure the rules governing the so called management of business without authority or negotiorum gestio of articles 1888 et seq. of the Spanish Civil Code, what would lead to a case of extralegal procedural substitution or sine titulo substitution. A negative answer must be given to this question, for several reasons that show that the management of business without authority is not consistent with the rules of the Spanish Civil Procedure Act.
