(RI §417335)
Unauthorized management of another person's businesses within civil proceedings: the inadmisibility of an extralegal procedural substitution or substitution “sine titulo” -

This paper analyzes if it is possible –or not--, and why, to apply to the Spanish civil procedure the rules governing the so called management of business without authority or negotiorum gestio of articles 1888 et seq. of the Spanish Civil Code, what would lead to a case of extralegal procedural substitution or sine titulo substitution. A negative answer must be given to this question, for several reasons that show that the management of business without authority is not consistent with the rules of the Spanish Civil Procedure Act.
