Las Constituciones árabes desde el Derecho Constitucional Comparado. (RI §416763)  


Arab constitutions from Comparative Constitutional Law - Manuel Fondevila Marón

Este trabajo pretende ser una reflexión acerca de las Democracias y Constituciones árabes en comparación con las occidentales, a propósito de la mal llamada “primavera árabe”. Frente a una visión eurocéntrica de la Democracia, sostenemos que es posible defender que el mundo árabe tiene su idea de Democracia y de Constitución, pero en este caso, las diferencias deben ser tomadas en cuenta a la hora de realizar una comparación. Nos centraremos en algunos elementos determinantes para nuestro juicio como es el factor religioso, la división de poderes, los Derechos Fundamentales etc. Ello nos permitirá extraer una idea de hasta qué punto es posible incardinar las Constituciones árabes dentro de la idea de Constitución.

This paper is a reflection on Democracies and Arab Constitutions compared with occidentals, with pretext the so-called Arab Spring. Faced with a Eurocentric view of democracy, we maintain that it is possible to argue that the Arab world has its idea of democracy and constitution, but in this case, the differences should be taken into account when making a comparison. We will focus, for our judgment, on some decisive elements as is the religious factor, the division of powers, fundamental rights etc. This will allow us to extract an idea of how far it is possible to add Arab Constitutions within the idea of Constitution.
