The act of government and judicial control: a comparative analysis in the Spanish law and Chilean law - Mariela Valdés Pérez

El control judicial de los actos de gobierno ha sido uno de los problemas más importantes con los que ha tenido que lidiar el Derecho administrativo. Sin embargo, en la mayoría de los países europeos en los que impera un Estado de Derecho, se han desarrollado técnicas que han permitido controlarlos judicialmente como es el caso del Derecho español el que experimentó una evolución de la absoluta inmunidad de estos actos al control judicial de los mismos. No obstante, existen otras realidades como es el caso del Derecho chileno en la que no se observa un desarrollo de técnicas que permita afirmar que en Chile si se controlan judicialmente este tipo de actos. Por lo tanto, la comparación de ambos Ordenamientos jurídicos nos revela importantes diferencias entre ambos Derechos lo que nos conduce a determinar la situación del control judicial en Chile respecto de esta materia.

The act of government and its judicial control have been an important problem for administrative Law, which has dealt with them for years. However, most European countries with State of Law have created some techniques which have let acts of government be reviewed in the Tribunals. An example of this is the Spanish Law that stopped the absolute immunity of this acts and progressed to control them in the Tribunals today. However, there are other realities like Chilean Law, which has not created techniques in this way, so it is very difficult to say that Chile controls the act of government in Tribunals. Therefore, we can see many important differences between both laws due to the comparison. This helps us to determinate the real situation the act of government and their judicial control in Chile.
