La Administración licita y adjudica un proyecto de obras que después no puede ejecutar por falta de financiación. La empresa adjudicataria pretende que se respete su derecho a la ejecución del contrato y el juez italiano le da la razón en primera instancia (2007). Ante la persistente inactividad, la empresa Pizzarotti recurre la no ejecución de la sentencia favorable y el Consiglio di Stato pregunta al Tribunal de Justicia si el cumplimiento del Derecho UE debe prevalecer sobre la cosa juzgada nacional.

A Local Administration bids and awards a project of public works that latter cannot be executed due to lack of financing. The building company which won the contest claims that his right to the execution of the contract awarded must be respected. The Italian administrative judge upholds the plea in the first instance (2007). Given the persistent administrative inaction, the company Pizzarotti appeals the non-execution of the favorable judgment and the Consiglio di Stato refers a preliminary ruling to the Court of Justice asking whether the fulfillment of the Law EU must prevail over the domestic res judicata.
