Examen crítico preliminar de la ley de navegación marítima en su relación con el convenio de trabajo marítimo 2006. (RI §415506)  


Preliminary and critical examination of maritime navigation law in relation to the ilo’s maritime labour convention 2006 - Francisco Arnau Navarro

Se analiza la relación entre en Convenio de Trabajo Marítimo y la nueva Ley 14/2014 de Navegación Marítima. En este examen inicial el autor advierte sobre la oportunidad perdida para elaborar un verdadero Código de Derecho Marítimo - que se aplaza para dentro de tres años- que contuviera realmente todos los aspectos relacionados con la navegación por mar, sin olvidar la regulación de las condiciones laborales de los marineros que se echa en falta en la mencionada Ley. La importancia que los gobiernos españoles han atribuido al Convenio, siendo España el primer país europeo en ratificarlo, no se corresponde, en opinión del autor, con la práctica legislativa y su necesaria implementación. Queda pendiente, sobre todo, cumplir las cláusulas del Convenio que obligan a su desarrollo legislativo.

The Maritime Labour Convention is groundbreaking Convention. It was adopted by the International Labour Conference in February 2006, coming into force in Spain in August 2013. It is intended to ensure decent working conditions for the world¬’s 1.2 million or more seafarers that work in an industry that transports 90 per cent of international trade. It sets out a seafarers’ bill of rights and describes as the “fourth pillar” of shipping regulation, alongside the three key IMO Conventions- SOLAS, MARPOL and STCW. Spain supports decent standards of labour for the world’s seafarers, just as the strong maritime safety and marine pollution prevention standards. Spain was the first European country to ratify the MLC, however the legislative implementation is very short. This article is a critical preliminary study on the new law of Maritime Shipping 14/14 in relation to CTM. Defects and shortcomings are prominent in the author's opinion in relation to MLC. A missed opportunity occurred of getting a true code of maritime law which is deferred for three years ahead.
