Los derechos de participación política de jueces y magistrados. (RI §415069)  


Political participation rights of judges and magistrates - Francisco Garrido Carrillo

En el estudio del estatuto del Juez y Magistrado es elemento transversal el ejercicio de la función que tiene encomendada, el ejercicio de la jurisdicción, y las condiciones en que esta ha de llevarse a cabo, es decir con independencia e imparcialidad. Hoy día esa independencia ha de circunscribirse tanto a la libertad de acción del juez, como a las garantías de esa libertad. En el análisis del Estatus de Jueces y magistrados hemos de ser conscientes de su doble naturaleza, como titulares de la función que desarrollan, y como sujetos de una relación dinámica de servicios de la función pública, es decir como funcionarios. Así pues desde la perspectiva de la independencia judicial como derecho del juez en cuanto titular de la función judicial nos permite distinguir dos tipos de derechos vinculados al ejercicio del cargo, unos corresponden a Jueces y Magistrados como titulares de la función judicial, y otros los ostentan como titulares de situaciones subjetivas de empleo. El Juez, además de Juez e integrante de uno de los poderes del Estado es también funcionario público y esto sin duda alguna se proyecta a los derechos de participación de los Jueces y Magistrados, en cuanto funcionarios públicos. Los derechos de participación los abordamos desde tres perspectivas, el derecho de asociación profesional y de afiliación a las mismas, el derecho a participar en los órganos de gobierno del poder judicial, y por último las asociaciones de jueces y el derecho de huelga. Estas son las tres líneas de trabajo para el estudio y análisis de los derechos de participación de los Jueces y Magistrados en cuanto trabajadores y funcionarios públicos, y titulares de dichos derechos, pero asimismo titulares de un poder del Estado. Esta naturaleza bifronte de los Jueces, sin que un perfil anule o se superponga a otro es esencial a la hora de abordar el diseño de nuestro marco jurídico actual, y la situación de los Titulares de la función jurisdiccional, profundizando en las inter-relaciones entre el juez- hombre, el juez funcionario y la función de juez.

One very important point to take into consideration in the field of the status applicable to Judges and Magistrates is the special jurisdictional function they perform and the way they carry out their functions, according to the principles of independency and impartiality. Nowadays, that independency must be considered in two different ways, containing both the judges´ freedom to act and the related guaranties. When analyzing the status of Judges and Magistrates, we have to acknowledge their dual nature: jurisdictional on the one hand as well as acting as civil servants on the other. Regarding the principle of judicial independency and the jurisdictional nature of Judges and Magistrates, we can distinguish two kinds of rights related to their position: some of them belong to Judges and Magistrates as invested by the judicial prerogatives; and others due to their position as civil servants. Judges and Magistrates are part of one of the governmental branches and, at the same time, they are civil servants, consequently, this dual character affects their rights of participation. This article focuses on the rights of participation of Judges and Magistrates in three different perspectives: the right of professional association and affiliation, the right to take part in the governing bodies of the Judicial Power, and the Judges and Magistrates´ right to strike. Through these three angles it is possible to analyze the rights of participation of Judges and Magistrates, in their dual position as State power and as civil servants. This dual nature of Judges and Magistrates, neither side of it in position to be cancelled or eliminated, plays an essential role in discovering the configuration of our current system, where it is needed to go deeper in the relationships between the judge as human being, the judge as civil servant and the function of the judge.
