El término “autonomía financiera” recoge varios aspectos de la libertad que tienen los gobiernos subestatales sobre sus recursos propios, como el derecho a introducir o abolir un impuesto, a establecer tipos impositivos, a definir las bases imponibles o a recurrir al endeudamiento. Las recientes reformas constitucionales han limitado la autonomía financiera de los gobiernos subestatales en España y Alemania en lo que se refiere a la potestad de endeudamiento. El presente texto pretende, tras algunas reflexiones sobre los argumentos a favor y en contra de la autonomía financiera de entes subestatales sostenidas en la literatura académica, analizar las bases constitucionales en ambos países en cuanto a la autonomía financiera. Finalmente, el texto se centrará en los efectos de constitucionalización del principio de estabilidad presupuestaria y el margen existente que poseen los gobiernos subestatales para seguir ejerciendo su autonomía financiera.

"Financial autonomy" refers to various aspects of the responsibilities of subnational governments e.g. the right to introduce or abolish a tax, to set tax rates or tax bases or to borrowing resources. The recent constitutional reforms have limited financial autonomy of sub-national governments in Spain and Germany with regard their power of borrowing. This article attempts, after some reflections on the arguments for and against the financial autonomy of subnational governments supported by the academic literature, to analyse the constitutional basis in both countries related to financial autonomy. Finally, it will focus on the effects of the recent constitutional reforms and the margin which subnational governments in both countries have to exercise their financial autonomy.
