(RI §414144)

Incestuous roman marriage by natural or spiritual kinship: divortium and tempus lugendi as limits to the disturbance of blood.

I. Introducción. II. VI. Conclusiones. VII. Bibliografía.

Palabras clave: Matrimonio; incesto; divorcio; viuda; padrino.;

With the accomplishment of the writing that follow we pretend to investigate about the social rejection that the relationships maintained between kin have had throughout History, making a special reference to incestuous and clandestine marriages from classical Rome to the emperor Justinian. In this sense, we will show how the roman people tried to limit the ligament through the establishment of divorce, the disturbance of blood when the widow did not respect the time of mourning required by Roman Law and, in general, all those relatives relationships. This will lead us, ultimately, to delve into the other restrictions on the marital bond arising from the postclassic period and with the advent of Christianity to the Empire.

I. Introduction. II. Socio-legal consideration of the blood kinship: Incest, secrecy and affinity since ancient Rome. 1. Legal justification for this matrimonial limitation because of the family relationship. 2. Natural or blood kinship and consanguinity. 3. The affinity kinship from classic time. III. The double bond or ligament as a matrimonial restriction on legal sources. IV. The tempus lugendi as a roman institution that guaranteed the paternity and prevented turbatio sanguinis. V. Special reference to other relationships between persons related naturally or spiritually: Sacrilegious and incestuous marriages under christian influence. VI. Conclusion. VII. Bibliography.

Keywords: Marriage; incest; divorce; widow; godfather.;
