En la actualidad el debate sobre la efectiva protección de los derechos humanos de las parejas del mismo sexo cada día cobra vital importancia, toda vez que aún los avances legales y constituciones en los distintos países, la comunidad LGBTI (Lesbianas, Gays, Bisexuales, Transgenerístas e Intersexuales), siguen siendo todavía discriminados, tachados y estigmatizados. Por ello, el debate en cuestión es una prioridad de índole mundial, pues dichas manifestaciones homofóbicas han estado presente a lo largo de la historia, circunstancia que no puede tolerarse en modelos de sociedades que pregonan la igualdad de género, la identidad sexual y el derecho a la diferencia. Por lo tanto, con este artículo se pretende hacer un estudio comparativo en el ámbito europeo y americano, para analizar cómo ha sido el proceso evolutivo de tales derechos.

At the present the debate on the effective protection of human rights of same-sex couples each day is of vital importance, since even legal developments and constitutions in different countries, LGBTI community (Lesbian, Gay, Bisexual, Transgender and Intersex), remain still discriminated against, labeled and stigmatized. Therefore, the debate in question is a priority of global nature, such as homophobic demonstrations have been present throughout history, a fact that can not be tolerated in models of companies touting gender equality, sexual identity and the right to the difference. Therefore, this article aims to make a comparative study in European and American has been analyzing how the evolutionary process of such rights.
