Trabajador fronterizo: la libre circulación de trabajadores, el principio de no discriminación por razón de nacionalidad y sus implicaciones fiscales (A propósito de la Sentencia del Tribunal de Justicia de la Unión Europea de 28 de junio de 2012, Asunto Erny). (RI §413851)

Trabajador fronterizo: Los ingresos que percibe en Alemania (Estado de empleo) tributan en Francia (Estado de residencia), una vez deducidas las cotizaciones sociales en Alemania. El cómputo, de forma ficticia, del impuesto alemán sobre los salarios tiene una incidencia desfavorable en la situación de los trabajadores fronterizos ya que la deducción ficticia de este impuesto, al determinar la base de cálculo del incremento en cuestión, desfavorece a las personas que, como el Sr. Erny, residen y están sujetos a imposición en un Estado miembro distinto de donde presta sus servicios, en relación con los trabajadores residentes y sujetos a imposición en dicho Estado. El incremento salarial tiene la naturaleza jurídica de retribución a los efectos de los artículos 45 TFUE y 7 del Reglamento relativo a la libre circulación de trabajadores dentro de la Unión.

Cross-border worker: the income he receives in Germany (country of employment) is taxed in France (country of residence), once the social contributions are deducted in Germany. The calculation, fictitiously, of the German taxes over the salary has a negative impact in the situation of the cross-border workers as the fictitious deduction of this tax, when determining the calculation basis of the relevant increase, is detrimental to the persons which, as Mr Erny, have their residence and are subject to taxation by a different country of the European Union from the one in which they render their services, in comparison with the workers which have their residence and also work in such country. The salary increase has the legal consideration of a remuneration for the purposes of Article 45 of the Treaty on the Functioning of the European Union and Article 7 of the rules and regulations relating to the free movement of workers within the European Union.
