Los tratados internacionales de Derechos humanos reconocen el derecho a la vida, pero la mayoría de ellos no determinan si las personas no nacidas quedan comprendidas en su ámbito de aplicación y cuál sería el grado de protección. Ante esta falta de concreción, la interpretación y aplicación de este derecho fundamental realizada por sus órganos de control resulta de especial importancia. El análisis de la jurisprudencia existente al respecto – fundamentalmente, de procedencia europea - nos permitirá contribuir a la delimitación del alcance subjetivo y objetivo de la protección del no nacido.

The international human rights treaties recognize the right to life, but most of them do not determine if the unborn is within its scope and what the degree of protection. Given this lack of specificity, the interpretation and application of this fundamental right by its supervisory bodies is particularly important. The analysis of existing case law about it - mainly from Europe - will enable us to contribute to the definition of subjective and objective scope of the protection of the unborn.
