The questionable legality of some reforms introduced by collective bargaining agreements after Royal Decree Law 3/2012 - Francisco Vila Tierno

En el año 2012, tras la entrada en vigor de la reforma laboral, se han publicado convenios colectivos cuyas cláusulas no parecen responder al principio de jerarquía normativa en relación a la redacción actual del Estatuto de los Trabajadores. El análisis realizado denota como los negociadores buscan fórmulas de dudosa legalidad para mantener la estructura tradicional del convenio o los efectos del mismo y como, de forma reiterativa, los textos convencionales superan sin problemas el control de la Administración laboral previo a su publicación. En cualquier caso, la aplicación estricta del referido principio de jerarquía debería suponer la inaplicación del convenio y, cuanto menos, que los negociadores apostaran por nuevas formas de regulación convencional.

After the entry into force of the Spanish labour reform in 2012 several collective bargaining agreements have been laid down including some terms and covenants which may not respond to the principle of the hierarchy of norms as to the current wording of the Statute of Workers’ Rights (Estatuto de los Trabajadores). The present study casts light on how (1) negotiators search for solutions of questionable legality so as to keep the traditional layout of the agreement or its effects, and (2) conventional legal texts pass repeatedly through the filters established by the Labour Administration prior to the adoption of the final agreement. In either case, the strict application of the above mentioned principle of the hierarchy of norms should result in the non application of the collective bargaining agreement, and that negotiators should strive for new tools of conventional regulations.
