El vago “sí” del Tribunal Constitucional. (RI §413682)  


The bum "yes" the Constitutional Court - María Martín Sánchez

El Tribunal Constitucional ha declarado la constitucionalidad del matrimonio entre personas del mismo sexo en su esperada Sentencia 198/2012, de 6 de noviembre. Este pronunciamiento supone el reconocimiento del derecho de toda persona a contraer matrimonio con otra, con independencia de su orientación sexual. Para ello el Tribunal ha hecho una extensa argumentación en torno al matrimonio y a su doble carácter, institución jurídica y derecho, en la que atendiendo a una “interpretación evolutiva”, declara que su reconocimiento a homosexuales no desnaturaliza ni pone en riesgo el matrimonio. Sin embargo, el Tribunal evita entrar en otros derechos involucrados, como la igualdad o el libre desarrollo de la personalidad, ni resuelve si la opción adoptada por el legislador es la más conveniente y respetuosa con el texto constitucional.

The Constitutional Court has upheld the constitutionality of marriage between same sex in their expected Judgment 198/2012, of November 6. This statement is a recognition of the right of everyone to marry another, regardless of their sexual orientation. Accordingly, the Court has made an extensive argument about marriage and its dual character, legal institutions and law, in which following a "evolutionary interpretation", states that his recognition of homosexual perverts or threatening marriage. However, the Court avoids entering other rights involved, such as equality or free development of personality, or resolve if the option adopted by the legislature is the most convenient and respectful of the constitutional text.
