LGBTI rights and spanish public administrations - María Díaz Crego

El trabajo presentado analiza la jurisprudencia de nuestros tribunales de lo contencioso-administrativo con el objetivo de identificar los principales problemas a los que ha tenido que hacer frente el colectivo LGTBI en sus relaciones con las Administraciones Públicas españolas. La metodología utilizada no permitirá identificar todos y cada uno de los retos que ha tenido que afrontar este colectivo, en la medida en que es probable que muchas decisiones y conductas discriminatorias no hayan llegado nunca ante la jurisdicción especializada. No obstante, entendemos que el trabajo realizado puede ser útil para realizar una valoración inicial del tratamiento recibido por este colectivo de las Administraciones Públicas españolas, así como del tratamiento judicial de las principales discriminaciones de que han sido objeto.

The aim of this paper is to identify the main challenges focused by the LGBTI community in their relationship with Spanish Public Administrations through the analysis of the Spanish tribunals case law on this topic. Although this analysis will not provide an exhaustive study of the problems faced by the LGBTI community- as we can agree that many discriminatory decisions and behaviours have never been the object of a judicial claim-, we consider that this paper will provide useful information about some of the problems faced by the LGBTI community in their relation with the Spanish Public Administrations and about how the judiciary have address this issues.
