The labour reform in Portugal - Jorge Leite

O texto trata da reforma laboral introduzida pela Lei n.º 23/2012, na sequência do Memorando de Entendimento subscrito entre o Governo Português e a Troika (FMI, CE e BCE), uma reforma concretizada em várias medidas cujo sentido geral é o da desvalorização do trabalho, nuns casos predominantemente económica e em outros casos predominantemente pessoal. As alterações mais significativas dizem respeito à (i) duração do trabalho (redução dos dias feriados e dos dias de férias e eliminação dos descansos compensatórios), ao (ii) trabalho suplementar (redução para metade da majoração remuneratória), à (iii) organização do tempo de trabalho (com particular interesse para as figuras das adaptabilidades e dos bancos de horas), à (iv) cessação do contrato com alterações do regime do despedimento por extinção do posto e por inadaptação e à (v) redução da compensação por despedimento por motivos objetivos e por outras formas a que a lei associa idêntico efeito. Registam-se ainda as alterações introduzidas no regime das relações coletivas e nas obrigações do empregador perante as autoridades do trabalho, matéria em que se mantém a tendência para a desadministrativização do «mundo do trabalho».

The most significant changes relate to: (i) working time (reduction in the number of public holidays and of the annual leave and elimination of compensatory rest); (ii) overtime work (halving the bonus remuneration); (iii) organization of working time (with particular interest in the regimes of adaptability and hour banking); (iv) termination of the contract with changes in the dismissal regime by extinction of the work post and for maladjustment; and (v) reduction of the dismissal compensation for objective reasons and other forms to which the law associates identical effect. There are still changes made to the system of collective relations and to the obligations of the employer towards labour authorities; an issue that continues to show a trend towards an de-administrativization of the "labour world".;
