Argumentos de dos Tribunales Constitucionales en materia de voto electrónico: Alemania y Austria. (RI §413544)  


Reasonings from two Constitutional Courts regarding electronic voting: Germany and Austria - Rosa Mª Fernández Riveira

Este trabajo de investigación estudia dos sentencias de dos Tribunales Constitucionales en materia de voto electrónico: por una parte, la sentencia de 3 de marzo de 2009 del Tribunal Federal Constitucional alemán y por otro, la sentencia de 13 de diciembre de 2011 de la Corte Constitucional austríaca. Ambos pronunciamientos establecen la inconstitucionalidad e ilegalidad del voto electrónico utilizado en los respectivos procesos electorales pero reflexionan, en sus fundamentos jurídicos, sobre diversos aspectos a tener en cuenta en aras de regular jurídicamente en un futuro voto electrónico.

This research studies two sentences of two Constitutional Courts in electronic voting: first, the judgment 3rd March 2009 from the German Federal Constitutional Court and on the other, the judgment 13th December 2011 from the Austrian Constitutional Court. Both pronouncements establish the unconstitutionality and unlawful of electronic voting used in the respective electoral processes but reflect, in their legal basis, on various aspects to consider in order to legally regulate electronic voting in a future.
