Una construcción incómoda del ius ad bellum. Juan Ginés de Sepúlveda y el humanismo jurídico en el colegio de San Clemente de Bolonia. (RI §413475)  


An inconvenient theory on ius ad bellum. Juan Ginés de Sepúlveda and legal humanism at San Clemente’s college in Bologna - Javier García

No se ha reparado en la posible influencia del humanismo jurídico en la obra de Juan Ginés de Sepúlveda. La complejidad del concepto “humanismo jurídico” frente a la limitada visión que la historiografía ha tendido a darle, identificándolo exclusivamente con su modalidad filológica (la depuración del Corpus iuris), ha hecho que este estudio opte por fijar la atención más en los principios que caracterizan la disciplina jurídica de la época respecto a dos temas en los que confluyen saberes diferentes al iniciarse la Edad Moderna: el ius gentium y el ius ad bellum. Para estudiarlos se ha elegido además una perspectiva que desborda el marco nacional: la disputa de las artes en la definición del primero y el Colegio de San Clemente y la Universidad de Bolonia, en el caso del segundo. La estancia en aquella institución de Sepúlveda y la consideración que hace del jurista Fortún de Ercilla, como preceptor, explican el estudio de la incidencia de la obra de éste en aquél. Junto a ello, y como medio con el que identificar las diferentes corrientes de pensamiento que en cuanto al ius ad bellum coexistieron en el citado Colegio, se lleva a cabo una comparación entre el Democrates y dos tratados colegiales de la época, muy diferentes entre sí, uno de ellos de Fortún de Ercilla.

It has not been noticed the influence that likely JuanGinés de Sepúlveda received from “Legal Humanism”. The complexity of the concept “Legal Humanism” in relation to a narrow-minded historiography that has tended to define it only as a philological movement (the criticism on Corpus iuriscivilis) ,has made this paper to focus on the principles that defines Law as an academic discipline at that moment. And also to relate it to two subjects in which different disciplines come together: iusgentium and ius ad bellum. In order to study them properly an international perspective has been adopted with regard to the debate among academic disciplines, on the one hand and the Spanish San Clemente’s College in Bologna, on the other. Sepulveda’s stay at that College and his judgementon Fortún de Ercilla –to whom he considered as a teacher- explain why this paper insists upon his influence on Sepúlveda. Moreover, as a way to identify different trends of thought inside the College, a comparison has been made between Democratesand two war treaties written by two San Clemente’s scholars, one of the by Fortún de Ercilla.
