A partir de lo que para el juez nacional, como juez comunitario, supusieron algunas sentencias del TJUE, como las dictadas en los asuntos Océano-Salvat Editores, Cofidis, Mostaza Claro, Rampion, Asturcom, Pannon y muchas otras, el presente comentario comienza destacando la agudeza que mostró el juez de lo mercantil nº 3 de Barcelona a la hora de detectar los problemas que podía plantear la correcta interpretación y aplicación de la Directiva 93/13, sobre cláusulas abusivas, en relación con el procedimiento de ejecución hipotecaria español. Éste no permitía, en efecto, la alegación de la nulidad de una cláusula del contrato supuestamente abusiva como causa de oposición, obligando por tanto al deudor a acudir a un procedimiento declarativo que, a su vez, prohíbe la paralización de la ejecución hipotecaria. La correcta vinculación de ambos litigios permitió al TJUE admitir la cuestión prejudicial planteada para dar una respuesta útil al juez nacional. De este modo, y tras considerar los privilegios de la ejecución hipotecaria en el ordenamiento jurídico español, se procede al análisis de la sentencia del TJUE de 14 de marzo de 2013 (Aziz-Catalunyacaixa), abordando sucesivamente el problema de la admisibilidad de la cuestión prejudicial, los obstáculos que las leyes procesales españolas suponen en esta materia para la adecuada protección del consumidor en relación con la Directiva 93/13, y los criterios que el TJUE ofrece al juez nacional para poder pronunciarse sobre el carácter abusivo de determinadas cláusulas, advirtiendo que la Directiva contempla algunas, pero tan sólo a modo de ejemplo. Por último, se reflexiona sobre la sentencia dictada por el juez de lo mercantil tras el pronuncimiento del Tribunal de Luxemburgo y se hacen unas breves consideraciones sobre el limitado alcance, en relación con lo resuelto en el asunto comentado, de la Ley 1/2013, de 14 de mayo, de medidas para reforzar la protección a los deudores hipotecarios, reestructuración de deuda y alquiler social.

Based on what for the Spanish judge, as a EU judge, was involved in the decisions of the European Court of Justice, such as those given out in the cases of Océano-Salvat Editores, Cofidis, Mostaza Claro, Rampion, Asturcom, Pannon, along with many others, this contribution begins by highlighting the professional acumen of the judge of the Commercial Law Court 3 in Barcelona on detecting the problems that could arise regarding the correct interpretation and application of Directive 93/13 concerning abusive clauses in relation to the enforcement of Spanish foreclosure laws. Indeed, this did not admit the allegation of the nullity of a presumably abusive contract clause as a reason for opposition, thus obliging the debtor to recourse to a declaratory procedure that in turn prohibits the halting of foreclosure. The accurate connection of both proceedings allowed the European Court of Justice to accept the preliminary ruling posed in order to offer the Spanish judge a usable way out. Thus, after considering the privileges of foreclosure in the Spanish legal system, an analysis was made of the ruling of the European Court of 14 March 2013 (Aziz-Catalunyacaixa), successively addressing the problem of the admissibility of the preliminary ruling, the obstacles that Spanish procedural laws imply in this matter for appropriate consumer protection with respect to Directive 93/13, and the criteria offered by the European Court Justice to the Spanish judge for him to be able to come to a decision regards the abusive nature of certain clauses, with the warning that the Directive does consider some of them but only as examples. Finally, we examine the ruling given by the Spanish judge of Commercial Law after the ruling of the Court of Justice in Luxembourg and offer some considerations concerning the limited reach, regarding the finding of the case in question, of the 1/2013 Act of 4 May of measures aimed at strengthening the protection of mortgage debtors, debt restructuring, and social leasing.
