Crime victims in the European Union. Analysis Directive 2012/29/EU - Susanna Oromí i Vall-Llovera

La Directiva 2012/29/UE del Parlamento Europeo y del Consejo, de 25 de octubre de 2012, por la que se establecen normas mínimas sobre los derechos, el apoyo y la protección de las víctimas de delitos, representa una decidida apuesta de la Unión Europea a favor de una víctima, que la realidad, siempre terca, nos echa en cara diariamente a través de las crónicas de sucesos. Con este trabajo se busca facilitar a los Estados la necesaria armonización de las normas y prácticas que comprende los derechos de la víctima, prestando especial atención al respeto a su dignidad, a su derecho a declarar y a ser informada, a comprender y ser comprendida, a ser protegida en las diversas fases de las actuaciones y a que se tenga en cuenta la desventaja de residir en un Estado miembro distinto del de la comisión del delito. Sin olvidar la justicia reparadora y/o la mediación penal, servicios especializados y organizaciones de apoyo a las víctimas, así como, la formación de los profesionales que entran en contacto con la víctima.

I. DERECHOS DE LAS VÍCTIMAS DE DELITOS EN LA UNIÓN EUROPEA. II. DERECHOS DE INFORMACIÓN Y APOYO: 1. El derecho a entender y a ser entendido y el derecho a traducción e interpretación; 2. Derecho a recibir información; 3. Derecho de acceso a los servicios de apoyo a las víctimas. III. DERECHOS DE PARTICIPACIÓN EN EL PROCESO PENAL Y EN LOS SERVICIOS DE JUSTICIA REPARADORA: 1. Derecho a ser oído; 2. Derechos en caso de que se adopte una decisión de no continuar el procesamiento; 3. Derecho a garantías en el contexto de los servicios de justica reparadora; 4. Derechos a justicia gratuita y al reembolso de gastos; 5. Derechos a la restitución de bienes y a la indemnización; 6. Derechos de las víctimas residentes en otro Estado miembro. IV. DERECHO A LA PROTECCIÓN DE LAS VÍCTIMAS Y RECONOCIMIENTO DE LAS VÍCTIMAS CON NECESIDADES DE PROTECCIÓN ESPECIAL: 1. Derecho a evitar el contacto entre víctima e infractor; 2. Derecho a la protección de la intimidad; 3. Derecho a la protección de las víctimas durante las investigaciones penales; 4. Derecho a la protección de las víctimas con necesidades especiales de protección durante el proceso penal: 4.1. Evaluación individual de las víctimas a fin de determinar sus necesidades especiales de protección; 4.2. Medidas especiales de protección de las víctimas con necesidades de protección y de las víctimas menores de edad durante el proceso penal. V. CONCEPTO DE VÍCTIMA Y DE VÍCTIMA ESPECIALMENTE VULNERABLE. VI. A MODO DE CONCLUSIÓN.

The directive 2012/29/EU of the European parliament and of the council, of 25 October 2012, establishing minimum standards on the rights, support and protection of victims of crime, represents a decided commitment of the Union, in favour of the victim, in which reality, always insistent, throws in our faces on a daily basis, through stories of incidents. This work seeks to provide States the necessary harmonization of regulation and practice contained in the standing as well as the main rights for the victim, with particular regard to their right to give a statement and to be informed, to understand and be understood, to be protected during the different stages of proceedings and to have the recognition of the disadvantage, which the fact of residing in a Member State other than that where the offence was committed, represents. Not forgetting restorative justice and / or penal mediation, specialized services and support to victims and the training of professionals who come into contact with the victim.

I. RIGHTS OF VICTIMS OF CRIME IN THE EUROPEAN UNION. II. RIGHTS OF INFORMATION AND SUPPORT: 1. Right to understand and to be understood; 2. Right to receive information; 3. Right of access to support services for victims. III. PARTICIPATION RIGHTS IN CRIMINAL PROCEEDINGS AND RESTORATIVE JUSTICE SERVICES: 1. Right to be heard; 2. Rights in the event of a decision not to prosecute; 3. Right to safeguards in the context of restorative justice services; 4. Rights to legal aid and to reimbursement of expenses; 5. Rights to the return of property and compensation; 6. Rights of victims resident in another Member State. IV. RIGHT TO PROTECTION OF VICTIMS AND RECOGNITION OF VICTIMS WITH SPECIFIC PROTECTION NEED: 1. Right to avoid contact between victim and offender; 2. Right to protection of privacy; 3. Right to protection of victims during criminal investigations; 4. Right to protection of victims with specific protection needs during criminal proceedings: 4.1. Individual assessment of victims to identify specific protection needs; 4.2. Special protection measures for victims in need of specific protection and child victims during criminal proceedings. V. CONCEPT OF VICTIM AND VICTIM PARTICULARLY VULNERABLE. VI. IN CONCLUSION.
