The adaptation of Castilla-La Mancha tourist legislation to the Directive on services in the internal market - Antonio Villanueva Cuevas

La Directiva de Servicios considera al sector turístico como uno de los ejemplos más representativos de aplicación de la misma, sin embargo, gran parte de su contenido no tenía cabida en la regulación autonómica del turismo vigente en el momento de la elaboración de aquélla, lo que ha sido aprovechado bien para articular nuevas leyes autonómicas de ordenación del turismo, bien para modificar las entonces existentes. Este estudio tiene como finalidad analizar las modificaciones que la Directiva de Servicios ha producido en la regulación del turismo en la Comunidad Autónoma de Castilla-La Mancha que, si bien ha seguido un procedimiento de reforma similar al desarrollado en otras Comunidades Autónomas, sus resultados han sido dispares y poco eficaces en algunos aspectos, sobre todo, por la falta de un desarrollo reglamentario adaptado al contenido de la normativa europea.

I.- LA DIRECTIVA DE SERVICIOS Y EL TURISMO: LA CREACIÓN DE UN ENTORNO FAVORABLE PARA EL DESARROLLO DE ESTE SECTOR. II.- LA TRASPOSICIÓN DE LA DIRECTIVA DE SERVICIOS A LA LEGISLACIÓN TURÍSTICA ESPAÑOLA. 1. Modificaciones en el ámbito competencial de la Comunidad Autónoma de Castilla-La Mancha en materia de turismo. 2. La implantación de la declaración responsable y de la comunicación previa para el desarrollo de las actividades turísticas. 2.1. Supuestos en los que se mantiene la necesidad de control administrativo previo. 3. La actividad administrativa de control a posteriori de las actividades y establecimientos turísticos. 4. The Directive on Services in the Internal Market understands to the tourist sector as one of the best examples for its implementation. Nevertheless, a larg part of its content could not be included in the regional regulation of the tourism that was in force when the Directive was adopted. Consequently, it has been necessary to pass new regional laws about tourist sector, or simply, to change the existing laws at that time. The objective of this study is to analyse the changes made in the Castilla-La Mancha tourist legislation. The conclusión is that Castilla-La Mancha has made a similar changes to others Autonomous Communities, but their results have been different and ineffective in several aspects, especially because the development of this regulation is still pending.
