Europeanization of the private international law: of Brussels Convention of 1968 to the Regulation (EU) 1215/2012. Notes on the process of construction of a judicial space european - Antonia Durán Ayago

Desde el Convenio de Bruselas de 1968 sobre competencia judicial internacional y reconocimiento y ejecución de resoluciones judiciales en materia civil y mercantil hasta el Reglamento (UE) 1215/2012, de 12 de diciembre, del mismo contenido, han transcurrido cuatro fructíferas décadas durante las cuales la Unión Europea -en su terminología actual tras el Tratado de Lisboa- ha ido poniendo las bases para la construcción de un espacio judicial europeo, en el que los derechos de los ciudadanos, con especial atención a la tutela judicial efectiva, sean una realidad sin posibilidad de ser cercenados por el cruce de fronteras. En este trabajo destacamos los principales pasos dados en este proceso y analizamos sus principales implicaciones.

From the Brussels Convention on Jurisdiction and the Enforcement of Judgments in Civil and Commercial Matters until the Regulation (EU) 1215/2012, of 12 December, of the same content, have passed four fruitful decades during which the European Union -in his current terminology after the Treaty of Lisbon- has gone putting the bases for the construction of a judicial space european, in which the rights of the citizens, with special attention to the effective judicial guardianship, are a reality without possibility to be mutilated by the crossing of borders. In this work stand out the main steps given in this process and analyse his main implications.
