Uma terceira via no controlo de constitucionalidade
Una tercera vía en el control de constitucionalidad. (RI §412823)  


A third way in judicial review - Carlos Blanco de Morais

En este trabajo se defiende la autonomía de una tercera vía en los modelos internacionales de control de constitucionalidad, el cual es seguido por Portugal y Brasil, y combina el tipo americano de la revisión concreta judicial con el "Verfassungsgerichtbarkeit" modelo de Austria y Alemania. Si los tribunales comunes pueden ejercer un control incidental, cuyas decisiones pueden ser recurridas ante los tribunales superiores y, finalmente, ante un Tribunal Constitucional (Portugal) o un Supremo Tribunal Federal (Brasil), que puede aprobar sentencias vinculantes con fuerza "inter partes", algunas instituciones políticas pueden impugnar directamente actos normativos en esos mismos tribunales supremos constitucionales, que deciden con fuerza obligatoria general. El artículo desarrolla las similitudes y diferencias entre los sistemas de los dos países de habla portuguesa, destaca los buenos logros alcanzados en la garantía de sus constituciones y aprecia la cantidad compleja y profusa de los procesos de control. Portugal cuenta con procesos judiciales de revisión, de omisión concretos y preventivos. Brasil tiene mucho más: un proceso común concreto, tres autos "concretos" para la protección de los derechos humanos fundamentales, tres sucesivos procesos abstractos de control, así como un mecanismo para el control de las omisiones legislativas. Las decisiones de manipulación, el perfil de la justicia constitucional, el activismo de los tribunales constitucionales y los debates acerca de la reforma o la transición a otros modelos también se destacó en este sentido, que concluyen con un análisis detallado de la "Regla Jupiteriana" de la Corte Suprema Federal de Brasil, uno de los tribunales constitucionales más poderosos del mundo. Este Tribunal está viviendo uno de sus más importantes "momentos de gloria" y el reconocimiento público, por lo que a veces el papel del legislador, interpretando la Constitución mediante sentencias progresivas pero polémicas, así también, los políticos corruptos en el ejercicio de sus poderes "originales". Algunas de sus sentencias normativas han producido "ruido y furia" pueden, sin embargo, cuestionar el respeto del principio de separación de poderes por el mismo poder judicial, el cual, tiene la especial tarea de protegerla.

This paper defends the autonomy of a third path in the international models of control of constitutionality, which is followed by Portugal and Brazil, and combines the american type of concrete judicial review with the “Verfassungsgerichtbarkeit” pattern of Austria and Germany. If common courts can exercise incidental control, whose decisions can be appealed to superior courts and, finally, to a Constitutional Court ( Portugal) or a Supreme Federal Court (Brazil) which can approve sentences with binding force “inter partes”, some political institutions can facial challenge directly normative acts in those same supreme constitutional courts, who decide with general binding force. The article develops the similarities and differences between the systems of the two Portuguese speaking countries, stresses the good achievements reached in the guarantee of their constitutions and appreciates the complex and profuse quantity of processes of control. Portugal has concrete, preventive, successive and omission processes of judicial review. Brazil has much more: a common concrete process, three concrete “writs” for protection of fundamental human rights, three abstract successive processes of control, and a mechanism for control of legislative omissions. Manipulative decisions, profile of constitutional justice, activism of the constitutional courts and discussions about the reform or the transition to other models are also stressed in these lines, which conclude with a detailed analysis of the “Jupiterian Role” of the Supreme Federal Court of Brazil, one of the more powerful constitutional courts of the world. This Court is living one of its most important “moments of glory” and public recognition, making sometimes the role of legislator, interpreting the constitution in a progressive but polemic way and sentencing, also, corrupt politicians when exercising its “original powers”. Some of its normative sentences produced with “sound and fury” can, nevertheless, question the respect for the principle of separation of powers by the same high judiciary which has the special task to protect it.
