El consentimiento en Derecho penal: causa de atipicidad, de justificación o de exclusión sólo de la tipicidad penal. (RI §412627)

Frente a las posiciones usuales dualistas o monistas sobre la ubicación sistemática del consentimiento eficaz (o en su caso del acuerdo o conformidad) dentro de la teoría del delito, aquí se sostiene una posición tripartita: El consentimiento jurídicamente válido, exigido en algunos tipos para la exención, pero de posible concurrencia real en todos los tipos que admiten la exención por consentimiento, puede suponer, o bien 1) atipicidad de entrada por total falta de relevancia jurídica, o bien 2) justificación de una conducta en principio relevante; y en ambos casos no hay responsabilidad penal ni otra responsabilidad jurídica. 3) En algunos delitos basta un consentimiento fáctico con más o menos requisitos, aunque no jurídicamente válido, para la exclusión solamente de la tipicidad penal, del ilícito penal tipificado, pero no de la posible responsabilidad jurídica extrapenal. Los requisitos de ambas clases de consentimiento jurídicamente válido son más exigentes, presuponen la plena capacidad y total ausencia de vicios, y en algunos casos las exigencias legales son aún mayores; en el consentimiento fáctico con el que se conforman algunos tipos los requisitos del consentimiento son menores, pero no uniformes, sino que dependen de los tipos respectivos.

Faced with the usual dualistic or monistic theories about the systematic placement of the effective victim’s consent (or the victim’s acquiescence) within the theory of criminal offence, in this article is defended a tripartite position: The existence of an effective consent, legally required by some criminal offences for exemption of criminal liability, that can also exist in all cases of criminal offences that admit the exemption of liability by consent, can mean either 1) Non-criminality of the conduct by complete lack of legal relevance, or 2) the justification of a conduct that initially shall be criminally relevant. In both cases there shall not be criminal liability, nor other legal responsibility. 3) In some criminal offences a factual consent of the victim, not legally valid, shall mean the exclusion of the existence of the punishable criminal offence, therefore the exemption of criminal liability, but there will remain other legal liabilities. Requirements for both classes of legally valid consent are more demanding. It is necessary the full capacity of the victim to consent and the absence of any flaw, and in some cases legal requirements are even higher. For the factual consent that is enough for some criminal offences, requirements are minor and will depend on the respective elements of each criminal offence.
Anders als bei den üblichen dualistischen oder monistischen Auffassungen über die systematische Stellung der wirksamen Einwilligung (bzw. des Einverständnisses) innerhalb der Verbrechenslehre wird hier eine dreiteilige Stellung vertreten: Die rechtlich völlig gültige Einwilligung, die von manchen Tatbeständen zur Strafausschließung verlangt wird, die aber auch tatsächlich im konkreten Fall bei allen die strafausschließende Wirkung der Einwilligung zulassenden Tatbeständen vorliegen könnte, kann folgende Effekte haben: entweder 1) Tatbestandslosigkeit von vornherein wegen völligen Mangels an rechtlicher Erheblichkeit, oder 2) Rechtfertigung eines in Ansatz erheblichen Verhaltens; in beiden Fällen gibt es weder strafrechtliche noch andere rechtliche Haftung. 3) In einigen Delikten genügt es mit einer faktischen, wenn auch nicht rechtlich völlig gültigen Einwilligung mit mehr oder weniger Erfordernissen zum Ausschluß nur des Straftabestandes, also des tatbestandsmässigen Strafunrechts, aber nicht der etwaigen außerstrafrechtlichen Haftung. Die Erfordernisse der zwei Arten rechtlich völlig gültiger Einwilligung sind anspruchsvoller: diese setzt volle Fähigkeit und keine Willensmängel voraus, und in bestimmten Fällen sind die gesetzliche ºForderungen noch grösser. Bei der faktischen Einwilligung, die für einige Tatbestände ausreicht, sind die Erfordernisse der Einwilligung niedriger, aber nicht gleichformig, sondern von den entsprechenden Tatbeständen abhängig.
