El artículo 317.5 de la Ley 30/2007 de 30 de Octubre, de Contratos del Sector Público- precepto introducido por la Ley 34/2010 de 5 de Agosto-, configura la potestad del órgano competente para resolver el recurso especial en materia de contratación, de imponer una sanción en caso de apreciarse temeridad o mala fe en la interposición del recurso o en la solicitud de medidas cautelares. Se intenta de este modo, siguiendo el Dictamen Número 499/2010 del Consejo de Estado, la articulación de un mecanismo que permita contrarrestar un ejercicio abusivo o fraudulento del recurso especial en materia de contratación.

I.- ASPECTOS ESENCIALES DE LA REFORMA OPERADA POR LA LEY 34/2010 DE 5 DE AGOSTO. II. LA POTESTAD DEL ÓRGANO COMPETENTE PARA LA RESOLUCIÓN DEL RECURSO ESPECIAL EN MATERIA DE CONTRATACIÓN, DE IMPONER MULTA EN CASO DE APRECIAR MALA FE O TEMERIDAD EN LA INTERPOSICIÓN DEL RECURSO O EN LA SOLICITUD DE MEDIDAS CAUTELARES. 2.1 Introducción 2.2 Antecedentes de la potestad del órgano competente para resolver el recurso especial en materia de contratación, de imponer una sanción en caso de apreciarse temeridad o mala fe: normativa reguladora de las reclamaciones económico administrativas. 2.3 Posición del Consejo de Estado y tramitación parlamentaria de dicha previsión legal 2.4 Requisitos para la aplicación del precepto. III.- CONCLUSIONES.

The 317.5 article of law 30/2007 of 30 October, of contracts in the Sector public - rule introduced by the law 34/2010 of 5 August-, sets up the power of the competent court to resolve the special recruitment resource to impose a sanction in case of reflected recklessness or bad faith on the commencement of the action or application of measures precautionary. Try this way, following the opinion number 499/2010 of the Council of State, the articulation of a mechanism to counter a fraudulent or abusive exercise of the special recruitment resource.
