El 11 de diciembre de 2008, la Asamblea General de las Naciones Unidas adoptó el Convenio de las Naciones Unidas sobre el Contrato de Transporte Internacional de Mercancías Total o Parcialmente Marítimo. La ceremonia para la firma tuvo lugar el 23 de septiembre de 2009 en Rotterdam, de modo y manera que este Convenio ha venido a conocerse como “Reglas de Rotterdam”. El objetivo de este Convenio -que reemplaza a las Reglas de la Haya, Reglas Haya-Vibsy y las Reglas de Hamburgo- no es otro que el de establecer normas uniformes para la modernización y armonización del régimen aplicable al transporte internacional de mercancías. En este sentido, como se sabe las Reglas de Rotterdam describen los derechos y obligaciones de las partes envueltas en el transporte de mercancías: el porteador y el cargador. Dentro del conjunto de novedades que en este Convenio se establecen, quizá quepa subrayar como las más importantes aquéllas que se refieren al sistema de responsabilidades del porteador y del cargador. Ahora bien, junto con estos aspectos, las reglas de Rotterdam se refieren en ocasiones a personas distintas de las partes integrantes del contrato de transporte, como por ejemplo, el capitán, la tripulación o trabajadores en general. En este contexto, el objetivo de este trabajo es analizar –en primer lugar- el papel que juegan los trabajadores en el ámbito de la regulación relativa a la responsabilidad y si es posible que se les impute algún tipo de responsabilidad en el contexto de este Convenio. En segundo lugar, se pretende analizar –también en el conjunto del sistema de atribución de responsabilidades- el alcance de lo dispuesto en el artículo 17.3.e) RR relativo a diversos supuestos de exoneración de responsabilidades del porteador. Particularmente, se establecen como causas para la exoneración total o parcial de la responsabilidad del porteador los siguientes eventos: huelgas, cierre patronal, interrupción del trabajo o reducción intencional del ritmo laboral.

El porteador como principal responsable de la ejecución del contrato de transporte.- III. La responsabilidad del porteador por pérdida o daño de las mercancías y por retraso en su entrega causados por actos y omisiones del capitán o de los miembros de la tripulación o por otros empleados del porteador. IV. La responsabilidad del porteador en los supuestos de huelga u otras acciones colectivas.

On 11 December 2008 the General Assembly of the United Nations adopted the UN Convention on “Contracts for the International Carriage of Goods Wholly or Partly by Sea”. A signing ceremony took place in Rotterdam on 23 September 2009 and the new Convention is known as “The Rotterdam Rules”. This Convention extends and modernizes the existing international rules relating to the contract of maritime carriage of goods. The aim is that the Convention will replace the Hague Rules, the Hague-Visby Rules and the Hamburg Rules and that it will achieve uniformity of law in the field of maritime carriage, as well as provide for modern industry needs in terms of door-to-door carriage. In this sense, as it is known, the Rotterdam Rules describes the rights and obligations of parties involved in the carriage of goods by sea. Whilst there are many changes to the carriage of goods by sea regime in the Convention, perhaps the most relevant of those concern the liability system of the carrier and of the shipper to the carrier. Nevertheless, the Rotterdam Rules include references to the persons other than the contracting parties in many places, as for example, the master, crew or employees in general; so that the focus of this paper would be –first of all- to pay attention to people other than contract parties in the liability system context to analyze if these people –employees- are or not liable under the Rotterdam rules. As well as we would like realize that in the Rotterdam rules liability exoneration system exist a rule in which the carrier is relieved of all or part of the liability if it proves one of the different events or circumstances have caused or contributed to the loss, damage or delay. In this sense, the paragraph (e) of article 17.3 establishes as a cause of total or partial exoneration the strike, lockouts, stoppages or restraints of labour. In this sense, our aim is to analyze the scope and limits of this exoneration.

I. The new regulation for the international carriage of goods wholly or partly by sea: the rotterdam rules.- II. The carrier like main liable person for the fulfillment of the contract of carriage.- III. Carrier´s liability for the breach of the contract of carriage caused by acts or omissions of the master or crew of the ship and other employees of the carrier.- IV. Carrier´s liability for the breach of the contract of carriage in case of strike, stoppage or restraints of labour.
