Study and commentary of the different classes of tutela mulierum according the roman juridical sources. Functions and responsibility of the tutor mulierum. - Laura Sanz Martín

El presente trabajo cierra el estudio de una materia “La tutela mulierum” cuya primera parte constituyó un artículo titulado “Fundamentos doctrinales en torno a la tutela mulierum. Naturaleza y esencia de la tutela mulierum, publicado en Rev. RGDR 12, www.iustel.com , 2009. Con esta nueva aportación doctrinal se intenta clarificar los problemas que las fuentes plantean a la hora de hablar de las diferentes clases de tutela mulierum. Del análisis de los textos que en este trabajo se citan, y al igual que ocurre con la tutela impuberum, se deducen tres clases de tutela mulierum, esto es, la tutela testamentaria, la tutela legítima y la tutela dativa, cuyas denominaciones y contenidos no son pacíficos entre la doctrina dada la ambigüedad terminológica que ofrecen las propias fuentes. La actuación del tutor mulierum como se desprende de este estudio, era puramente patrimonial, pues si tenemos en cuenta la naturaleza de la institución tutelar que nos ocupa, la mujer necesitaría la participación del tutor no para complementar su capacidad de obrar sino para poder disponer “libremente” de su patrimonio y realizar aquellos negocios que considerara convenientes a sus intereses, de manera que para aquellos casos en los que el tutor se negara a prestar su auctoritas, la mujer podría ejercitar la optio tutoris y en algunos casos, existiendo iusta causa, recurrir ante el magistrado para que este le obligara a dar su consentimiento. Por todo ello vemos como la tutela mulierum se articula como un mecanismo de control patrimonial a favor del tutor que va perdiendo operatividad a medida que la propia institución va perdiendo su justificación y razón de existir.

The present work closes the study of a matter "The Tutela mulierum" whose first part constituted an article titled "Doctrinal foundations around tutela mulierum. Nature and essence of the tutela mulierum, published in Rev. RGDR 12, www.iustel.com, 2009. With this new doctrinal contribution it is tried to clarify the problems that the sources outline when speaking of the different classes of Tutela mulierum. With the analysis of the texts cited in this work, and the same as with the Tutela impuberum, three classes are deduced of Tutela mulierum, these are, Tutela testamentaria, Tutela legítima and Tutela dativa, whose denominations and contents are not agreed upon the doctrine, given the terminological ambiguity that the very sources offer. The function of the tutor mulierum as is seen in this study was purely patrimonial, because if we keep in mind the nature of the guardian institution that occupies us, the woman would need the tutor's participation to supplement their capacity to work but to be able to have their patrimony "freely" and carry out those transactions they considered convenient to their interests, so that for those cases in which the tutor refused to lend his auctoritas, the woman could exercise the optio tutoris and in some cases, in which iusta causa, existed appeal before the magistrate so that he could force the tutor to give his consent. For these reasons, we see how the tutela mulierum is articulated as a mechanism of patrimonial control in favor of the tutor that loses operability as the very institution loses its justification and purpose.
